Changes to Conveyancing (General) Regulation 2018

The Conveyancing (General) Regulation 2018 commenced on 1 September 2018.

Clause 31 of the regulation requires that a  plan of survey that was completed more than two years before lodgment may not be accepted unless accompanied by a Certificate of Currency - signed and dated by a registered surveyor.

If a plan older than two years is lodged without the Certificate of Currency a requisition will be sent to the lodging party. Further examination of the plan will await lodgment of  the Certificate of Currency at NSW LRS.

The Certificate of Currency will apply to all deposited plans of survey, excluding Survey Information Only Plans, Strata Plans and Compiled Plans.

The certificate of currency must be lodged as approved form Plan Form 6CC as an additional sheet to the administration sheets of the plan.
