Additional Fees

NSW LRS Additional Fees – Item 7 of Schedule 1 of the Real Property Regulation 2014 

There are various dealing and transaction types that will be subject to an additional fee pursuant to Item 7 of Schedule 1 of the Real Property Regulation 2014.

Item 7 of Schedule 1 of the Real Property Regulation 2014 states:

In addition to any other item, on lodgment of an application (other than an application to dispose of Crown land arising from the closing of a public road under the Roads Act 1993), request, dealing or caveat that will result in making, altering or removing more than 1 recording--for each additional recording

Commencing 28 August 2018 an additional fee under Item 7 will be payable for each additional recording where more than one action is being undertaken on the one form. 

The examples in the Item 7 Examples Table below indicate how the fee will be assessed by NSW LRS in relation to a number of Dealings.

Dealing Type

Additional Fee Payable

Discharge of Mortgage (05DM)

An additional fee is payable for each additional mortgage where more than one mortgage by the same mortgagee is being discharged on the one form.

Withdrawal of Caveat (08WX)

An additional fee is payable for each additional caveat where more than one caveat by the same caveator is being withdrawn on the one form.

Discharge of Charge (06DC)

An additional fee is payable where more than one charge by the same chargee is being discharged on the one form.

Lease (07L) – Implied Surrender

An additional fee is payable for an implied surrender. A current lease noted on the Torrens Title Register may be surrendered by an incoming lease if the new lease:

-  is to all of the current lessees, or is accompanied by:
  • a Surrender of Lease form 07DL as regards those lessees not -  included in the incoming lease; or
  • the consent of the current lessee
-  affects at least the same land or premises
-  commences before the expiry of the current lease and
-  is not made subject to the current lease.

Lease (07L)

A lease by the same lessee of different premises on 2 or more adjoining land titles in the same ownership can be:

-  lodged as a single lease;
-  must describe the premises as they affect each respective land title (e.g.     shop 1 in 1/SP723 and shop 2 in 2/SP723 respectively); and
 - will be charged an additional fee for each additional land title.

Sublease (07SL)

An additional fee is payable for each additional lease where more than one lease by the same lessor and lessee are being sub-leased on the one form.

Variation of Easement (20EV)

An additional fee is payable for each additional easement where more than one easement is being varied on the one form.

Transfer Including Covenant (Form 01TCV)

The lodgment fee of a transfer including covenant includes the fee payable for the covenant.

 An additional fee is payable for each additional covenant  where more than one covenant  is being created on the one form.

Transfer Including Easement (01TE)

The lodgment fee of a transfer including easement includes the fee payable for the easement.

An additional fee is payable for each additional easement where more than one easement is being granted on the one form.

Transfer Granting Easement (01TG)

An additional fee is payable for each additional easement where more than one easement is being granted on the one form.

Application For Recording of Road Action Affecting a Western Lands Lease (19MB) Road Closures

An additional fee is payable for each additional road closure notification being removed from the one form.
