NSW Land Registry Services (NSW LRS) and the Office of the Registrar General have issued a new guideline to assist with the preparation of a lease of premise and deposited plan for the construction and operation of solar farms in NSW.
A solar farm lease defines the site that is leased from landowners (proprietors) for a solar farm within a property. A solar farm will typically utilise several properties and there is a separate lease between the proprietor and the solar farm operator for each property. The accompanying deposited plan defines the position of each solar farm site in a plan of survey across all properties.

The RG’s Guidelines set out the requirements for lodging plans, transfers, leases and other dealings with NSW LRS. They assist customers and lodging parties with preparing plans and dealings for lodgment by setting out the requirements of applicable legislation and Lodgment Rules.
The solar farm lease guideline was developed by NSW LRS in consultation with the Office of the Registrar General and industry representatives from the legal and surveying professions and renewable energy operators. NSW LRS thanks those stakeholders for their contribution to the guideline’s development.
The solar farm lease guideline complements the existing RG’s Guideline regarding leases required to construct and operate windfarms.
