From 8 August 2022, ELNO Subscribers will no longer be required to provide supporting evidence including identity documentation, Probate, Letters of Administration, Death Certificate and Passport when lodging the following Dealing with Exception documents with NSW LRS:
- Change of Name (10CN)
- Notice of Change of Address for Service of Notices or Name of Caveator (08CX Form)
- Notice of Death (02ND)
- Transmission Application by Devisee, Beneficiary or Next of Kin (03AD)
- Transmission Application by Executor, Administrator or Trustee (03AE)
This will ensure consistency between the evidence requirements for documents lodged as
Structured Electronic Dealings and
Dealing with Exception.
What do I need to know?
- ELNO Subscribers are still required to verify the identity of their Client, establish their Client’s right to deal and retain evidence to support the dealing in accordance with ARNECC Guidance Note 5. More information about the eConveyancing Subscriber Compliance regime can be found through the Office of the Registrar General’s website.
- Where the above Dealing with Exception documents are lodged prior to 8 August 2022, they must be accompanied by the current standard of supporting evidence.
- NSW LRS retains the right to request further evidence to support the examination of a dealing in certain circumstances.
