NSW Land Registry Services (NSW LRS) advises customers and lodging parties that the next staged change to the plan currency time limit under the Conveyancing (General) Regulation 2018 takes effect on 1 September 2019.
From 1 September 2019, lodging parties are required to submit a Certificate of Currency for plans lodged more than three (3) years after the survey completion date.
Surveyors can complete the Certificate of Currency using approved Plan Form 6CC as an additional sheet to the administration sheets of the plan.
If a plan older than three years is lodged without a Certificate of Currency, the plan cannot be registered and a requisition will be sent to the lodging party. Under the Regulations, further examination of the plan must wait until the Certificate of Currency is lodged with NSW LRS.
The next step in the transition to the 2 year plan currency period
Clause 31 of the Conveyancing (General) Regulation 2018 sets time limits on the validity of Survey Certificates that accompany plans of survey. Under the Regulation, these time limits are being introduced in stages to assist industry to transition to this new requirement.
Under the staged approach, surveyors are required to prepare a Certificate of Currency to accompany lodged plans that are lodged more than five, three and two years after the survey completion date as set out below:
- For plans lodged on or after 1 September 2018 until 31 August 2019, a Certificate of Currency is required where the survey was completed more than 5 years prior to lodgment.
- For plans lodged on or after 1 September 2019 until 31 August 2020, a Certificate of Currency is required where the survey was completed more than 3 years prior to lodgment.
- For plans lodged on or after 1 September 2020, a Certificate of Currency is required where the survey was completed more than 2 years prior to lodgment.
